1.1.5. Partner Integration Services Facilitating connections with licensed FinTech companies for jurisdictionally appropriate financial products enabling clients to leverage asset value, and insurance company partnerships for asset coverage provision.
1.1.6. Global Compliance Infrastructure GDPR and CCPA compliant data processing, SOC2 compliant security framework, and multi-jurisdictional operational capabilities across the United States, Asia, Europe, Oceania, and offshore territories.

All fees are due when services are rendered unless otherwise agreed in writing. You agree that DiscoverArte and its third-party payment processors may store your payment information for recurring charges. If you dispute any charges, you must notify us within 60 days of the charge. All fees are non-refundable except as expressly provided herein or required by law.
You agree to comply with all applicable laws and regulations in connection with your use of the Services. In particular, the following is a representative, non-exhaustive list of prohibited acts:
UNDER NO CIRCUMSTANCES WILL DISCOVERARTE, ITS AFFILIATES, EMPLOYEES, AGENTS, REPRESENTATIVES, LICENSORS OR OTHER THIRD PARTY PARTNERS ("COMPANY PARTIES") BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
OUR LIABILITY FOR ISSUES RELATED TO ASSET AUTHENTICITY, VALUATION, MARKET PERFORMANCE, PHYSICAL CONDITION, THEFT, DAMAGE, OR LEGAL TITLE DISPUTES SHALL BE LIMITED TO THE FEES PAID FOR PROCESSING THE SPECIFIC ASSET IN QUESTION. WE ARE NOT LIABLE FOR MARKET LOSSES, AUTHENTICATION DISPUTES, PHYSICAL ASSET DAMAGE OR THEFT, VALUATION CHANGES, LIQUIDITY CONSTRAINTS, OR REGULATORY CHANGES AFFECTING YOUR ASSETS.
A COMPANY PARTY'S TOTAL CUMULATIVE LIABILITY SHALL IN NO EVENT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DISCOVERARTE FOR YOUR USE OF THE SERVICES IN THE PRIOR TWELVE (12) MONTHS; AND (B) THE SUM OF FIVE THOUSAND (5,000) US DOLLARS (USD).
You agree to defend, indemnify and hold the Company Parties harmless from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of or relating to:

These Terms and any dispute shall be governed by the laws of Delaware, without reference to choice of law rules. The arbitration will be conducted in accordance with the JAMS Comprehensive Arbitration Rules and Procedures. The arbitrator's decision shall be final, binding, and non-appealable.

These Terms, along with the Privacy Policy and any additional terms for specific Services, constitute the entire agreement between DiscoverArte and you with respect to your use of our Services.
We may modify these Terms at any time by posting updated Terms with a later effective date. Continued use of the Services after such posting constitutes acceptance of the modified Terms.
These Terms shall be governed by the laws of Delaware. Subject to the arbitration provisions above, the parties consent to jurisdiction in Dover, Delaware and waive objections to such jurisdiction and venue.
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the rest of these Terms remain in full force and effect.
